SolarWinds (NYSE:SWI) confirmed on Friday that it received a Wells notice from the Securities and Exchange Commission over the 2020 data breach that impacted the company.
In an 8-K filing, SolarWinds (SWI) said that the company, certain current and former employees of the company, including its CFO and Chief Information Security Officer, were the recipient of Wells notices.
“The Wells Notices provided to these individuals each state that the SEC staff has made a preliminary determination to recommend that the SEC file a civil enforcement action against the recipients alleging violations of certain provisions of the U.S. federal securities laws,” the company wrote in the filing.
SolarWinds (SWI) added that it will “vigorously defend itself” and a spokesman told Reuters that the company is cooperating with the SEC investigation and that it has “acted properly at all times.”
The SolarWinds (SWI) hack started in 2019 but it was not until 2020 when it was first detected. The incident, widely believed to be attributed to Nobelium, a Russian hacker group, impacted more than 250 of SolarWinds customers, including Microsoft, Nvidia and several U.S. federal agencies, including the Department of Defense and Department of Homeland Security.
SolarWinds (SWI) shares fell 1.7% on Friday to close at $9.92 but are up more than 5% year-to-date.
