Illegal Immigrant Amnesty Buried in GOP-Backed Ag Bill

Buried in the GOP-led Securing Agriculture’s Workforce Act is a pathway to temporary legal status for some illegal immigrant farmworkers. While the effort has earned praise from agriculture groups, many immigration hawks are raging over what they argue is effectively amnesty for illegal immigrants who should be deported.

Agricultural Amnesty

Introduced by veteran House Agriculture Chair G.T. Thompson (R-PA), the bipartisan bill would give illegal immigrants the opportunity to obtain H-2A visas if they’ve worked in agriculture since May 31, 2026. The H-2A program allows American employers “to bring foreign nationals to the United States to fill temporary agricultural jobs,” according to US Citizenship and Immigration Services.

In addition to providing a waiver for illegal immigrants, the bill would also allow employers who’ve hired illegal immigrants to evade accountability. Nearly 50 Republicans have backed the legislation.

“With the border now secure, it is time to address these shortcomings and provide fair and legal pathways for all of agriculture to obtain workers when they are unable to find U.S. citizens willing to perform these noble but arduous tasks,” Thompson wrote in a letter obtained by Politico late last month.

‘No Amnesty!’

Thompson’s bill triggered intense backlash this week from many of President Donald Trump’s supporters, who argue the legislation is a betrayal of the president’s base and his mass deportation efforts. 

“We voted for Trump specifically to solve the immigration problem, to get mass deportations, that’s what was promised,” said Republican Randy Westlund, mayor of Post Falls, Idaho. “To see something going against that is going against the MAGA agenda.”

According to the Department of Labor’s National Agricultural Workers Survey (NAWS), a government survey that gathers information on “the legal status of farmworkers in the United States,” the most recent available data shows between 37% and 47% of farmworkers “on U.S. farms producing crops” were unauthorized to work in the United States between 2021 and 2022. That means “roughly 327,000 farmworkers on U.S. crop-producing farms” may lack the permission to work in the US.

Notably, the survey does not include workers on “dairy, poultry, hog, or other livestock-related farms” – so the 327,000 figure is likely much larger. Former US Border Patrol commander Gregory Bovino spoke out against Thompson’s bill, writing on X: “These Republicans just stabbed Trump’s deportation promise in the back with an amnesty farm bill. They’re only gonna [sic] get the message one way. Vote every single one of them out in a massive wave, and replace them with real immigration hawks. Anything less, and they’ll never take us seriously.”

Florida Governor Ron DeSantis, a Republican, joined in the chorus of amnesty opponents, writing: “No amnesty! Amnesty is NOT what people voted for in 2024!” The House Freedom Caucus, a group of conservative lawmakers led by Congressman Andy Harris (R-MD), also mocked the legislation on social media.

When asked about the bill, President Trump said he isn’t familiar with it, but that he will “take a look at it.” In the meantime, some experts claim the agricultural sector is facing a shortage that would be exacerbated by mass deportations – but is there a shortage, or are Americans just unwilling to work for wages suppressed by illegal immigrant workers? Either way, Republicans will have a hard time convincing Trump’s base that temporary legal status is anything other than amnesty by another name.
