Sen. Cynthia Lummis Says Clarity Act Talks With Democrats Continue Daily

The CLARITY Act remained in focus after Senator Cynthia Lummis said negotiations with Democrats are continuing daily, while Senate leaders still plan to consider the crypto market structure bill before the August recess.

Lummis Says Senate Is Still Working Toward Floor Vote

Senator Cynthia Lummis said lawmakers continue to negotiate the CLARITY Act after nearly 11 months of discussions. Speaking in a Fox Business interview, she said the Senate is still expected to consider the legislation before lawmakers leave for the August recess.

Lummis said Senate Majority Leader John Thune has reserved time for the bill on the Senate agenda for several weeks. She added that she believes the Senate leader intends to move forward with the legislation despite ongoing negotiations.

In a post on X, Lummis wrote, “I am continuing to work with Democrats every day on the Clarity Act.” She added, “I worked late last night on the CFTC portion of the bill and I’m proud that @POTUS has gone further than any president in history to protect ethics.” 

She also urged lawmakers to support the legislation, writing, “Let’s provide a clear regulatory framework and keep this industry here in the United States by passing the Clarity Act.”

Ethics and CFTC Provisions Remain Under Discussion

Lummis said negotiations continue around the Commodity Futures Trading Commission section of the bill, along with law enforcement measures and ethics provisions. Those areas remain the primary subjects of discussion between Republicans and Democrats.

She also called on Senate Democrats to support the legislation in another social media post. Lummis wrote, “Senate Democrats should think hard before killing a bipartisan Clarity Act 11 months in the making.” She added that the bill “protects consumers, arms law enforcement, keeps this industry in America,” and includes “a historic ethics agreement covering the President, VP, Congress & federal judiciary.”

Senator Bill Hagerty also urged the Senate to move the legislation forward. He said lawmakers should allow a floor vote instead of extending negotiations. Hagerty stated, “We have to pass the CLARITY Act. I think we should put it through a vote on the floor of the United States Senate and find out where Democrats stand.”

Anthony Scaramucci also pointed to possible movement on the bill. In a post on X, he referred to “cloture tomorrow,” after previously describing the CLARITY Act as one of the most important financial market bills in recent years.

Bill Faces Uncertain Path Before August Recess

The House approved the CLARITY Act in July 2025 with bipartisan support, while the Senate Banking Committee advanced its version in May 2026. Despite that progress, the bill still requires 60 Senate votes to advance beyond cloture.

Several Democrats continue to seek changes involving ethics rules, illicit finance measures, and stablecoin yield provisions before supporting the legislation. Those discussions have slowed efforts to schedule a final vote.

The legislation would establish the regulatory boundary between digital commodities and securities, create registration requirements for exchanges, brokers, and token issuers, and assign the CFTC authority over crypto spot markets on regulated platforms.

Supporters argue that statutory legislation would provide a lasting regulatory framework beyond agency rulemaking. Earlier this year, Congress also passed the GENIUS Act, marking another step in digital asset legislation as lawmakers continue debating the broader CLARITY Act.
